Florida Telehealth Client Information and Rights

Overview

The following information is provided for individuals receiving counseling services from Pattern Shift Counseling, PLLC while physically located in Florida. It explains the Counselor’s Florida telehealth authorization, professional regulation, telehealth services, confidentiality, emergency resources, access to records, and complaint procedures.

Florida Telehealth Authorization

Jason Joseph is a Texas Licensed Professional Counselor who is authorized by the Florida Department of Health to provide telehealth counseling services to clients physically located in Florida through Out of State Telehealth Provider Registration TPMC8094. This authorization permits him to provide telehealth services in Florida but does not constitute a Florida mental health counseling license.

Services for clients located in Florida are provided exclusively through telehealth. The Counselor does not maintain an office in Florida and cannot provide in person services in Florida under this registration.

When providing services to a client located in Florida, the Counselor must practice within the scope established by Florida law, meet the prevailing Florida professional standard of practice, and document telehealth services according to the same professional standard applicable to in person services.

Professional Regulatory Authority and Complaints

Telehealth counseling services provided to clients located in Florida are subject to regulation by the Florida Department of Health and the Florida Board of Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling.

Clients may contact the Department or Board to verify the Counselor’s registration, ask questions about professional regulation, or file a complaint concerning services provided to a client located in Florida.

Telehealth Services

All counseling services provided by Pattern Shift Counseling to clients physically located in Florida are delivered through telehealth technology.

Telehealth allows counseling to occur while the client and Counselor are in different physical locations. Potential benefits include easier access to care and the convenience of meeting from a location of the client’s choosing. Potential limitations or risks include technology interruptions, privacy limitations, technical difficulties, and reduced access to some forms of nonverbal information.

At the beginning of each session, clients are asked to confirm their current physical location. Counseling may be provided only while the client is physically located in a jurisdiction where the Counselor is legally authorized to provide services.

Clients may withdraw consent for future telehealth services at any time. Because the Counselor cannot provide in person services in Florida, withdrawing consent for telehealth would ordinarily require ending services or transferring care to another provider.

Confidentiality

Participation in counseling, communications with the Counselor, and records maintained about clients are generally confidential and protected by applicable Florida and federal law.

Confidentiality is subject to limited exceptions. These may include circumstances involving suspected abuse, neglect, abandonment, or exploitation of a child or vulnerable adult; a specific and immediate threat of serious harm to an identified or readily available person; a valid court order or other legal requirement; a complaint or legal claim involving the Counselor or Practice; professional consultation; coordination of care when authorized or otherwise permitted by law; or another disclosure required or permitted by applicable law.

Emergency Information

Pattern Shift Counseling does not provide emergency, crisis, overnight, or on call services.

If you are experiencing a mental health emergency, call 911, call or text the 988 Suicide and Crisis Lifeline, contact an appropriate local crisis service, or go to the nearest emergency department.

Requesting Access to Your Records

You may request access to counseling records maintained by Pattern Shift Counseling, subject to limited exceptions permitted by Florida and federal law.

Records for services provided while you are physically located in Florida will ordinarily be retained for at least seven years after the date of the last contact, or longer when another legal or legitimate professional requirement applies.

A written records request should include:

Your date of birth

A description of the records requested

Dates of service, if known

Where the records should be sent

Identity verification may be required before records are released. Depending on the request and applicable law, the Practice may provide copies of records, a treatment summary, or a report of examination and treatment. A reasonable reproduction fee may apply when permitted by law.
